Welcome to HealthSmile by Wattana Medical & Wellbeing Co., Ltd., a health screening service provider designed specifically for those who want to have health screenings based on their risks, and provides blood sampling services based on the needs of users. The purpose of this Terms of Service is to inform you of your rights and legal obligations between “us”, “Wattana Medical & Wellbeing Co., Ltd.” as the “service provider”, and “you” as the “user”. Therefore, please read the Terms of Service carefully to benefit from our services.

By agreeing to apply for any type of HealthSmile service, the user is deemed to have accepted that they have read and understood the terms of service in detail and that the user accepts all terms of service. These terms are legally binding on the user.

1. Conditions of use of online services

1.1. ผู้รับบริการสามารถลงทะเบียนเป็นสมาชิกออนไลน์ สามารถสั่งซื้อสินค้าและบริการต่างๆที่บริษัท วัฒนา เมดิคอล แอนด์ เวลล์บีอิง จำกัด จัดทำขึ้นในเว็บไซด์ได้

1.2. ผู้รับบริการที่มีอายุต่ำกว่า 18 ปี บริบูรณ์ การทำธุรกรรมใดๆที่เกี่ยวข้องกับการเงิน เช่น การซื้อบริการทางการแพทย์ออนไลน์ จะต้องได้รับความยินยอมจากบิดา มารดา หรือผู้ปกครองดูแลก่อน

1.3. บริษัท วัฒนา เมดิคอล แอนด์ เวลล์บีอิง จำกัด อาจไม่ให้บริการทางการแพทย์หากพบว่า ผู้รับบริการให้ข้อมูลอันเป็นเท็จในส่วนที่เป็นสาระสำคัญ เช่น ชื่อ-สกุล, ประวัติการรักษาที่ผู้รับบริการต้องแจ้งให้ทราบ เป็นต้น

1.4. ข้อมูลด้านสุขภาพของผู้รับบริการถือเป็นความลับส่วนบุคคล ทางบริษัท วัฒนา เมดิคอล แอนด์ เวลล์บีอิง จำกัด จะไม่นำไปเปิดเผยโดยไม่ได้รับความยินยอมเป็นลายลักษณ์อักษร และจะปฏิบัติตาม นโยบายคุ้มครองข้อมูลส่วนบุคคล (Privacy-policy) ของบริษัทอย่างเคร่งครัด

1.5. การชำระเงิน การขอคืนเงิน หรือการยกเลิกการทำธุรกรรมผ่านเว๊บไซด์ให้เป็นไปตามเงื่อนไขทางกฎหมาย หรือข้อกำหนดระหว่างคู่สัญญากับผู้ใช้บริการโดยตรง โดยมีรายละเอียดดังนี้ ช่องทางชำระเงิน (Payment channel) และ นโยบายการคืนเงิน และการยกเลิกการสั่งซื้อสินค้า

2.4 You have the right to assign any person or company to be a user in the system to enter information or manage the use of services of Wattana Medical and Wellbeing Co., Ltd. according to the service package you choose. You will be responsible for any actions that users in the system have taken as if they were your own actions, whether such actions were with your knowledge or not. If the actions of users in the system cause damage or loss of benefits to you, the company will not be responsible in any way.

3. Limitation of Liability

3.1 Although Wattana Medical and Wellbeing Co., Ltd. has every intention and effort to provide the service with full efficiency, the company cannot guarantee that your use of the service will be free from defects (including but not limited to injuries from multiple blood draws, complications from blood draws, delays in reaching the destination, etc.). This is because it is well known that the system related to providing medical services is uncertain and may cause interference or obstacles to your use of our service.

3.2 Wattana Medical and Wellbeing Co., Ltd. is not responsible for any damages resulting from the use of the service or from any defects in the use of the service for any reason, except for damages resulting from the intention or gross negligence of the Company.

In such case, the Company shall limit its liability for actual damages incurred by you, whether directly or indirectly, to a maximum not exceeding the service fee rate that the Company has received from you in the year in which the event causing the damages occurred.

4. Applicable Law and Jurisdiction

These HealthSmile Terms of Use are governed by the laws of Thailand, without regard to choice of law or conflict of law rules or provisions, and the courts in the Kingdom of Thailand shall have exclusive jurisdiction to resolve any disputes arising under these Terms of Use.

5. Wattana Medical and Wellbeing Co., Ltd. reserves the right to change the terms of service at any time.

Changes are deemed effective immediately upon posting on the website. Wattana Medical & Wellbeing Co., Ltd. will do its utmost to notify all users of such changes via email or website. It is the customer’s responsibility to read and understand the latest Terms of Service as published on the website.

6. Refund Policy

Wattana Medical & Wellbeing Co., Ltd. is pleased to refund the full amount in the event that the company is unable to deliver the product/service as specified by the company. However, such event must not be caused by the buyer’s mistake or the buyer obstructs the delivery of the product/service in any way.

In case the customer pays the full amount or pays in installments via a credit card of a commercial bank registered in Thailand, the company will forward a refund request to the bank. The refund will depend on the policy of each bank. Normally, the cardholder will receive a refund in the next billing cycle.

In the case that the customer pays the full amount via a debit card of a commercial bank registered in Thailand, the company will forward a refund request to the bank. The refund will depend on the policy of each bank, which will take 30-60 days to refund from the date the customer is notified by the Call Center.

Unable to cancel, change, or edit product/service orders. In the following cases:

8.1 HealthSmile is the owner of the copyright and intellectual property rights in all information displayed, images and display formats as they appear on the website, unless otherwise clearly stated. No one is allowed to copy, reproduce, have a copy, keep a backup, imitate, make an analogy, modify, add to it for distribution for any other purpose without written consent from HealthSmile, unless otherwise specified in the agreement and conditions on the website.

8.2 The information or electronic documents in your Account are your property. However, access to such information or electronic documents is subject to the condition that you have paid the service fee in full and you are deemed to have permitted HealthSmile to use, copy, send, store or back up such information or electronic documents for the purpose of providing HealthSmile services for your benefit in accessing various information conveniently and quickly.

8.3 Backup and storage of your data are very important policies and practices in providing services of HealthSmile. We have measures to maintain your data according to international standards to prevent the loss or damage of data. However, HealthSmile cannot guarantee that your data will not be lost or damaged in any way, which may occur due to force majeure or unforeseen factors. Therefore, you are responsible for backing up or copying any data or documents that you wish to send into the system by yourself in another way for the best benefit in preserving your data. HealthSmile has no liability in case of data loss or damage.
